The Gibbons E-Discovery Law Alert analyzes current issues, concerns, and developments in electronic discovery and corporate information management law. The blog is co-edited by Mark S. The Gibbons E-Discovery Task Force is a nationally recognized, interdisciplinary group that comprises more than 15 practicing attorneys, numerous IT and litigation specialists, and the firm’s Chief Technology Officer. At its inception, the Task Force had a dual mandate – to institute a comprehensive, ongoing education program for all Gibbons attorneys and to counsel the firm's clients in this cutting-edge discipline. As we foresaw, today, companies of all sizes routinely face tremendous challenges in the areas of electronic discovery and information management. These include compliance with sweeping changes to the Federal Rules of Civil Procedure, new and evolving standards of practice, and hundreds of legal opinions that have introduced into the litigation lexicon issues that only ten years ago were rarely, if ever, discussed – spoliation of electronic evidence, litigation hold and preservation, electronic production format, FRE 502, and metadata, among many others. The Task Force regularly assists its clients in facing and surmounting all of these challenges.
Mark S. Sidoti

Mark S. Sidoti is Chair of the Gibbons E-Discovery Task Force, which provides counseling, training and litigation-related assistance to companies on information management and e-discovery matters. He frequently publishes and lectures on best practices in these areas and is a member of numerous standard setting organizations in the e-discovery field, including the Defense Research Institute’s Electronic Discovery Committee (where he serves as Chair-Elect), the Sedona Conference Working Groups 1 and 6, Electronic Discovery Reference Model (“EDRM”) and various E-Discovery advisory boards. He was counsel for the plaintiff in the well known Treppel v. Biovail case, which resulted in several reported decisions that have been recognized as among the most important e-discovery opinions to date. Mr. Sidoti received his B.S., summa cum laude, from Fordham University and his J.D. from Fordham University School of Law. He is recognized by New York Super Lawyers for Civil Litigation Defense.
Jeffrey L. Nagel

Jeffrey L. Nagel is a senior member of the Gibbons E-Discovery Task Force advising clients on document retention and E-Discovery best practices. Mr. Nagel is also experienced in the strategic planning, management, trial and appeal phases of complex litigation, as well as arbitration. He has successfully represented public and private companies, and their management, in litigation involving a wide range of corporate governance, securities and competition issues, including claims involving partnership disputes, hedge fund issues, breach of contract, fiduciary duty, fraud, and malpractice claims. He received his A.B., magna cum laude, from Cornell University, his M.A. from New York University, and his J.D., magna cum laude, from New York University School of Law.
Melissa DeHonney

Melissa DeHonney is a member of the firm’s E-Discovery Task Force and has written on numerous e-discovery issues, including the discoverability of litigation hold letters, spoliation sanctions and the admissibility of electronic evidence. In practice, Ms. DeHonney has managed large-scale e-discovery cases as well as second-chaired an arbitration proceeding brought against a firm client that was dismissed on spoliation grounds. Ms. DeHonney received her B.A., cum laude, from Rutgers University and her J.D. from Fordham University School of Law.
Phillip J. Duffy

Phillip J. Duffy is a founding member of the firm’s E-Discovery Task Force. He frequently advises clients, publishes and lectures on information governance, legal hold and e-discovery best practices. He is a member of the Defense Research Institute’s (DRI) Electronic Discovery Committee where he has served as Annual Meeting Liaison and Membership Chair. Mr. Duffy has lectured and published on a range of e-discovery and information governance topics, including records management best practices. He received his B.A. from Rutgers College and his J.D., cum laude, from Seton Hall University Law School and is listed in Super Lawyers for Personal Injury Defense: Medical.
Mara E. Zazzali-Hogan
